What a Green Card Actually Is

A Green Card (Form I-551) is physical proof of lawful permanent resident (LPR) status. It is not citizenship, but it puts you on the path. After 5 years (3 years if married to a U.S. citizen) you may naturalize. A valid card must be renewed every 10 years (Form I-90, $455 + $85 biometrics).

The Three Main Pathways in 2026

1. Family-Based Immigration (FB)

Congress caps family Green Cards at 480,000 per year minus immediate relatives. There are two sub-groups:

2. Employment-Based Immigration (EB)

Annual worldwide limit: 140,000 principal + derivative family. Divided into five preference levels:

  • EB-1 – priority workers (extraordinary ability, outstanding professors, multinational executives). Current for all countries in 2026 except China & India (2 yr backlog).
  • EB-2 – advanced degree or exceptional ability. Backlog 4 yrs India, 2 yrs China, current elsewhere.
  • EB-3 – professionals & skilled workers. Backlog 6 yrs India, 3 yrs China, current elsewhere.
  • EB-4 – special immigrants (religious, juveniles, etc.). Usually current.
  • EB-5 – investors $800k+ in a Targeted Employment Area. Quota unused in 2025, so 2026 is effectively current.

3. Diversity Visa 2026 (DV-2026)

Congressionally mandated lottery: 55,000 visas for natives of countries with low U.S. immigration rates. Online entry period is expected to open October 2 – November 5, 2025 (check dvprogram.state.gov). Results available May 6, 2026. Selectees must be document-ready by fiscal-year end (30 Sep 2027) or lose the number.

Document Checklist (All Categories)

Keep two identical sets: one for USCIS/NVC, one for the consulate interview.

    • Police certificates from every country lived 6 months+ since age 16 (FBI for US stays)

    • I-693 Medical (civil surgeon, sealed envelope, valid 2 yrs since 2025)
    • I-864 Affidavit of Support + IRS transcripts last 3 yrs + job letter
    • DS-260 confirmation page (IV) or I-485 receipt (AOS)
  3. Category-Specific
    • Family: marriage certificate, divorce decrees, photos, joint statements
    • Employment: ETA-9089 (labor cert), I-140 approval, employer letter still valid at I-485/interview
    • Diversity: high-school diploma or O*NET job zone 4/5 proof, DV selectee letter

Step-by-Step Application Process

Because 90% of my clients are outside the US, I’ll outline Consular Processing. If you are already in the US in legal status, you may file I-485 Adjustment of Status instead—same documents, different sequence.

Family-Based Consular Processing

  1. USC petitioner files I-130 ($535, online at myaccount.uscis.gov). Attach beneficiary’s documents.
  2. Wait for I-130 approval (8-14 months at USCIS; check processing times).
  3. Case goes to National Visa Center (NVC). Pay Affidavit of Support fee $120 + IV fee $325 per person via ceac.state.gov.
  4. Upload civil & financial documents to CEAC. NVC review time: 6-10 weeks.
  5. Schedule medical & interview. Embassy emails you appointment 4-6 weeks ahead.
  6. Attend interview. If approved, passport returned with visa within 7-10 days. You must enter the US before visa expiry (usually 6 months).
  7. Pay USCIS immigrant fee $220 online before entry to receive the physical Green Card by mail.

Employment-Based Consular Processing

  1. Employer obtains labor certification (ETA-9089) from DOL (6-10 months).
  2. Employer files I-140 with USCIS ($715 + $2,500 premium optional). Wait for approval.
  3. Wait for priority date to become current (check monthly Visa Bulletin).
  4. NVC invoices & same CEAC steps as family (fees $120 + $325).
  5. Interview, medical, entry, $220 fee. Job must still exist and employer must provide “still-needed” letter.

Diversity Visa 2026

  1. Enter online Oct-Nov 2025 (eDV.state.gov). One entry per person; spouses may each enter.
  2. Check result May 6, 2026. Save confirmation number.
  3. Submit DS-260 immediately after selection. Do not wait for case number.
  4. NVC emails document instructions when your number becomes current (usually July 2026).
  5. Interview before Sep 30, 2027 or number expires. Police certs & high-school evidence mandatory.
